General Conditions – Service Pack Coffee Corner 8GRAMS SRL/BV
1. Contract Duration:
The rental contracts are established for a duration of 24, 36, 48, or 72 months for the coffee machines offered by 8GRAMS SRL/BV.
2. Rental Rates:
The monthly rental rates are specified in the commercial offer and vary depending on the duration of the contract and the selected coffee machine model.
3. Payments:
Payments are due each month on the date specified in the rental contract. Invoices will be sent electronically.
4. Consumables and Maintenance:
Consumables such as filters, milk, or sugar, for example, are not included in the rental rates. Maintenance is included in the Coffee Corner Service Pack rate and will be carried out by 8GRAMS SRL/BV during the monthly coffee delivery, if necessary.
5. User Responsibility:
It is the responsibility of the user to take care of the coffee machines and to use them in accordance with the provided instructions. Any damage caused by incorrect or abusive use will be charged to the user.
6. Breakdown and Repairs:
In case of machine breakdown, our company will cover the necessary repairs during the rental period. A loan coffee machine will be provided during this period.
6.1 Definitions:
- Breakdown: Any malfunction preventing the normal use of the coffee machine resulting from an internal phenomenon.
- Replacement item: In order of priority, a refurbished item of identical model to the rented item, a refurbished iso-functional item, or a new iso-functional item.
- Refurbished item: Device restored to the same level of technical and functional characteristics as the original rented item, packaged in a neutral box, and subjected to renovation or repair operations.
- Iso-functional: Item possessing at least the same main technical characteristics as the rented item, except for characteristics of weight, size, brand, color, coating, graphics, and design.
- After-Sales Service (SAV): The service provided by 8GRAMS SRL/BV to meet the maintenance and repair needs of rented coffee machines.
6.2 General Conditions:
The Lessor, 8GRAMS SRL/BV, ensures a comprehensive After-Sales Service for the rented coffee machines. In case of a reported breakdown, the Lessee is invited to contact 8GRAMS Customer Service at +32 495 18 47 29 (service available Monday to Friday from 10 AM to 6 PM, cost of a local call).
Following a phone diagnosis and confirmation of the breakdown by 8GRAMS Services, the machine will be repaired or replaced with a Replacement item at 8GRAMS’ convenience.
In the case of workshop repairs, coffee machines will be taken care of by an express shipping service to be sent to the technical station. An assessment will be made, and repairs will be carried out if necessary.
If the repair period exceeds 60 days or if the machine is deemed irreparable, a Replacement item will be provided to the Lessee, either an identical product (with the same technical characteristics) if availability permits, or an equivalent reference with the prior agreement of the Lessee.
The color of the replacement product does not affect its technical characteristics and may therefore differ from the original machine.
7. Contract Termination:
The rental contract can be terminated before its expiration with a 4-week written notice. Early termination fees equivalent to 6 (six) months of service will be charged in case of early termination of the contract, to be paid within 30 working days after the notice announcement.
8. Property and Insurance:
The coffee machines remain the property of 8GRAMS SRL/BV throughout the rental contract duration. The user is responsible for obtaining appropriate insurance to cover the machines against any damage or loss.
9. Applicable Law and Jurisdiction:
These general conditions are governed by the laws in force in Belgium. Any dispute arising from these general conditions will be subject to the exclusive jurisdiction of the competent courts of Liège, Postal Code 4000.
